BSW has a seasoned team of lawyers, with almost 100 years of combined experience, that guide clients through ever-changing legal, policy, and political trends in environmental law and regulation. Our team has former regulatory officials and attorneys who maintain strong relationships with the Louisiana Department of Environmental Quality, the Louisiana Department of Natural Resources, the U.S. Environmental Protection Agency, the U.S. Department of Justice, and the U.S. Army Corps of Engineers.
Our team has significant experience with the Clean Air Act, the Clean Water Act, the Resource Conservation and Recovery Act (RCRA), the Endangered Species Act, and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), and all parallel state regulations and statutes.
With our deep knowledge and hands-on experience, we assist clients with permitting, compliance, environmental justice, site selection, due diligence, civil and criminal investigations, environmental site assessments, expansions, and land use. We advise clients on the effects of federal and state regulations on their operations, such as initial plant construction, expansion, and ongoing operations, to prevent non-compliance.
We also have an experienced litigation team that handles administrative and judicial matters. Our team has represented defendants in litigation spanning from defense of claims of personal injury, defense of mass torts and class action complaints, to make-or-break hearings before administrative bodies. We defend our clients in a broad spectrum of issues arising from industrial accidents, alleged exposures to chemicals, wrongful death, and legacy lawsuits.
Our background and experience covers the following:
-
Administrative matters, including working with regulatory agencies in permitting, compliance, and remediation matters;
-
Appeals, judicial and administrative;
-
Site selection issues, including environmental justice, brownfield/greenfield issues, and local land use ordinances;
-
Enforcement, including civil and criminal matters and defense of citizen suits;
-
Toxic torts defense, including defense for class actions suits;
-
Remediation, including cost recovery and contribution actions;
-
Insurance recovery disputes; and
-
Natural resources damages liability.
We represent a range of clients, both large and small, from individuals to Fortune 500 corporations, from small companies to large industrial plants and international companies, governmental entities, and non-profit institutions. Our clients vary across industries, including petro-chemical manufacturers, oil and gas exploration and production companies, bulk liquid terminals, and local governments.
